Eventually, after numerous collection avenues were exhausted, you filed a civil lawsuit and obtained a judgment. But the debtor still refuses to pay. What is your next step?

A judgment is only a piece of paper. The Court cannot force a debtor to pay you any money. The first thing to do is consult an attorney. I handle a wide range of post judgment remedies, including:

  • Liens — a lien may be recorded in any county where the judgment debtor holds real property.
  • Foreclosures on mortgages, liens and UCC security interests — if the creditor has obtained a security interest on real or personal property in exchange for credit, the property may be foreclosed upon
  • Judgment depositions — a deposition in which sworn testimony is elicited from debtors concerning their assets and bank accounts
  • Domestication of foreign judgments — judgments from other states are recorded in Kentucky so that collection efforts can begin
  • Replevin actions — filed by secured creditors to take possession of collateral securing loans or other debts, such as gaining possession of a vehicle following payment default
  • Wage and non-wage garnishments — a creditor can obtain the debtor's property that is held by a third party, such as an employer or bank or other financial institution
  • Attachments — if property of the creditor is in the debtor's possession, a sheriff will serve a writ of attachment and the attached property will be sold at a sheriff's sale and the proceeds will be paid to the creditor to satisfy the debt
  • Writ of Execution — a sheriff will serve a writ of execution and levy property owned by a judgment debtor to satisfy the judgment. The property will then be sold at a sheriff's sale and the proceeds paid to the judgment creditor.
