How to Prevent Wage Garnishments

First, the creditors called your home and demanded payment. Then they hired a collection agency or even an attorney to pursue aggressive collection efforts against you. Now they have gone a step further and even started garnishing your wages to pay back unpaid debts.

If you are having your wages garnished or you are being threatened with wage garnishment, the time has come for you to fight back and retain an attorney. Before things get even worse and they come after your personal property, car or even your home, retain an experienced bankruptcy and debt relief attorney who will fight to protect your rights.

The Automatic Stay

When you file for bankruptcy, an automatic stay is placed on all further collection activity by most creditors. With the exception of child support and a few other limited types of debt, all debt collection must cease. Bankruptcy will help you to stop wage garnishment.

There are two types of bankruptcy that are most commonly filed by individuals. Chapter 7 bankruptcy completely eliminates most unsecured debts like credit card debts and medical bills. Chapter 13 bankruptcy creates a debt repayment plan that gives people in debt the opportunity to repay their debts more gradually over a three to five year period. Both Chapter 7 and Chapter 13 bankruptcy can be used to stop wage garnishment.
