Chapter 13 Bankruptcy and Home Loan Modifications
If you are struggling with an unmanageable debt load, bankruptcy may be the answer for you. I handle both Chapter 7 and Chapter 13 bankruptcy cases. Chapter 13 is more commonly used by people with stable monthly incomes who are seeking to avoid a home foreclosure. A Chapter 13 bankruptcy creates a debt repayment plan that allows people to pay back debts in a more gradual fashion in accordance with a three or five year debt repayment plan approved by a bankruptcy court judge.
If the court approves your proposed debt repayment plan, which I can draft and submit on your behalf, your home mortgage lender must abide by the terms of the bankruptcy court order. Chapter 13 bankruptcy may allow you to pay back mortgage arrears over time, reduce late penalties and give you time to get back on your feet.
